Park Rental and Rules
RULES RELATING TO THE USE OF AND GOVERNING THE ACTIVITIES IN LOST CREEK MUNICIPAL UTILITY DISTRICT'S PARKS AND RECREATIONAL FACILITIES
The following rules govern the use of the District's park properties and facilities by members of the public. These rules define the general privileges of use relating to the parks and recreational facilities and do not create rights of use. The Board of Directors of the District retains the authority to modify these Rules at any time, and the District's General Manager is authorized in his or her discretion to revoke, suspend, or modify any person's privileges of use upon good cause.
(a) Hours of Operation and Curfew.
The General Manager is authorized to establish and post the hours during which the District's park and recreational lands shall be open from time to time. The General Manager is also authorized to modify the park hours without prior notice in response to unusual circumstances or special events, including inclement weather and periods required for park repair or maintenance. Notwithstanding the foregoing, a curfew is hereby established within the District's park areas as follows:
Greenbelt - Sunset (or for so long thereafter as it remains light) each day until 8:00 a.m. Central Time the following day (or at such earlier time as it becomes light).
Boulder Trail Park - Sunset (or for so long thereafter a it remains light) each day until 8:00 a.m. Central Time the following day (or at such earlier time as it becomes light); and
Playground Area - 10:00 p.m. Central Time until 8:00 a.m. Central Time the following day (or at such time as it becomes light). The General Manager is hereby authorized to grant exceptions to the foregoing curfew period for individual activities upon prior written request, and may establish reasonable conditions related to any park use during curfew periods to minimize any impact on surrounding property owners.
(b) Use of Subject Tracts by Minors.
Adults should accompany children when coming to, utilizing or leaving the Greenbelt, Playground Area or Boulder Trail Park. Children under the age of seven (7) years using the Greenbelt, Playground Area or Boulder Trail Park shall be accompanied by a supervisor over the age of fourteen (14) years at all times.
(c) Destructive Activities.
Activities of any kind, whether conducted within or outside the Playground Area, Greenbelt, or Boulder Trail Park that cause or are likely to cause destruction, damage, defacement or other injury to the parks, recreational areas or to the improvements and facilities thereon, other than ordinary wear and tear, are prohibited. This provision does not apply to persons lawfully engaged in activities exercised pursuant to established rights and privileges, such as pursuant to public utility and drainage easements, nor in activities specifically authorized, approved or directed by the District. The harm, damage or removal of vegetation is strictly prohibited in all District park areas.
(d) Organized Sporting Events.
No organized sporting events, team practices, team games or similar events of any kind may be conducted within Boulder Trail Park. The General Manager of the District is authorized to determine whether any event or activity within the park violates the foregoing prohibition, and may terminate any activity that he or she determines to be in violation of the prohibition.
(e) Group Events.
Any organized event or activity at any District park area that includes or may include more than 25 participants must receive prior authorization from the District's General Manager.
(f) Missiles Prohibited.
Hurling, throwing, discharging, firing or propelling by any means any missile in, across, into or from the Playground Area, Greenbelt, or Boulder Trail Park is prohibited. This prohibition applies, by way of example but not by way of limitation, to firing, discharging, or shooting firearms, pellet guns, air guns, fireworks, slingshots, bows and arrows, and blow guns; and throwing stones, darts, knives, spears and javelins. This prohibition does not apply to balls, frisbees and other play and athletic objects (other than those specifically named in the preceding sentence) used in the usual and ordinary way in the course of play, exercise or an athletic activity. Upon written authorization of and under reasonable conditions established by the General Manager or any authorized representative of the District designated by the General Manager, activities otherwise prohibited by this Section may be conducted.
(g) Golf Prohibited.
Golf is prohibited in all District park areas.
(h) Glass Containers.
Except as may be authorized by the District's General Manager, no person shall possess, carry, discard, deposit, use or bring on or to the Greenbelt any glass container.
Place trash in trash receptacles only. Littering, dumping or depositing trash or waste of any type on any park lands or in park waters is prohibited.
(j) Disorderly Conduct, Loud or Offensive Activities, and Public Intoxication.
- Any activity within the Playground Area, Greenbelt, or Boulder Trail Park that constitutes a felony, a crime involving moral turpitude, assault, criminal mischief, or disorderly conduct within the meaning of Section 42.01, Texas Penal Code, as the same is now or hereafter amended, is prohibited.
- Public intoxication within the meaning of Section 49.02, Texas Penal Code, as the same is now or hereafter amended, is prohibited within the Playground, Greenbelt, or Boulder Trail Park.
- No conduct, excessively loud music or noise that may disrupt the use and enjoyment of District parks by others, or that may impact surrounding property owners and residents, is permitted. The General Manager is hereby authorized to determine whether any activity, music or noise is disruptive, and is authorized to take all actions reasonably necessary to abate the offensive conduct, including ejecting the offender(s).
(k) Bicycles, Motor-Driven Vehicles and Equipment.
The use or operation of motor-driven vehicles or motor-driven equipment within the District's parks is prohibited. This prohibition does not apply to the use and operation of motor-driven vehicles and motor-driven equipment related to the construction, operation, and maintenance of the park and recreational lands and the improvements and facilities thereon by authorized personnel and representatives of the District or other governmental agencies in carrying out their responsibilities and duties, nor to persons engaged in activities conducted pursuant to established rights and privileges, such as pursuant to public utility and drainage easements, or in activities specifically authorized, approved or directed by the District. The use of bicycles within the Playground Area is prohibited. In the Greenbelt and Boulder Trail Park, bicycles may be used on established trails or paths only, and shall yield to pedestrians at all times.
Parking of vehicles at Boulder Trail Park shall be in designated places only, and shall be "head-in" only. Parking at all District parks shall be conducted so as to allow for ingress and egress by other vehicles and park users. Parking of vehicles at all District parks is strictly prohibited except for parking conducted in conjunction with the use of the park during authorized hours. The District may have any vehicle towed at the expense of the owner if the vehicle is parked in violation of these rules.
Dogs and other pets are prohibited within the Playground Area. Dogs and other pets at the Greenbelt and Boulder Trail Park must be on a leash and under the control of the handler at all times. The handler of each pet shall pick up and dispose of all animal wastes in proper on-site animal waste receptacles, if available, or in offsite waste receptacles if no animal waste receptacles are present. All dogs shall have current rabies vaccinations and shall wear visible dog tags. No aggressive dogs or pets are allowed in the District's parks at any time. Handlers are responsible for any and all injuries or damage caused by pets within the District's park areas. Pet handlers must comply with all rules posted at the District's individual park areas.
(n) Use of Waterways.
The waters of Barton Creek within the Greenbelt are waters of the State of Texas over which the District has no jurisdiction. Said waters are not park or recreational areas of the District. Any person using, entering, or swimming in such waters do so at his or her own risk.
(o) Posting of Signs and Posters.
The posting of signs, posters, fliers, advertisements and similar literature are strictly prohibited in all District parks, except in areas specifically designated therefore, or in locations approved in advance of posting by the District's General Manager.
Fires are prohibited in all District park areas except within the confines of permanent barbeque grill areas. All users of the grill equipment shall properly and thoroughly extinguish all fires and coals before departing the park area. The General Manager is authorized to prohibit fires within designated barbeque grill areas during drought and other high-risk fire periods.
Smoking is NOT permitted in any District park.
(r) Alcoholic Beverages.
The use, presence or consumption of alcoholic beverages within the District's parks is strictly prohibited.
Peace officers, the General Manger of the District, and any authorized representatives of the District designated by the Board of Directors or the General Manager of the District are authorized to implement and enforce the provisions of these rules. In addition, peace officers are authorized to make arrests when necessary to prevent or abate the commission of any violation of these rules. The General Manager or his authorized representative is hereby authorized to eject, or cause the ejection of, any person or persons who violate any of the District's rules concerning park use, whether set forth herein or posted at the park area.
In addition to any penalty provided by the laws of the State of Texas, any person violating these Rules will be subject to a District penalty up to $500 each day for each violation. The District shall seek full restitution for any damage to District property caused by any person that violates these park rules.
Rules Governing Reservation of Equipment
Residents of Lost Creek may reserve the gazebo and gas grill in the Playground Area, community room in the MUD's office building, and the barbeque grills in Boulder Trail Park for community or private parties. The gazebo and the community room may be used on a walk-in basis, provided no one else has reserved it for that specific time.
Reservations and Cancellations.
Reservations for the gazebo and the gas grill at the Playground Area, community room in the MUD's office building and the barbeque pits at Boulder Trail Park may be placed with the M.U.D. office staff up to sixty (60) days in advance. Reservations will be made for a specific period of time. In consideration of other residents, please call the M.U.D. office as soon as possible to cancel a reservation.
A refundable equipment and clean-up/damage deposit of $100.00 is required for all reservations. The reservation is secured when the deposit check has been received in the M.U.D. office. It will be returned after a satisfactory inspection of the facility at the conclusion of the reservation. Any unreturned equipment, damage, unapproved usage, or required maintenance "out of the ordinary" identified by M.U.D. staff will be charged to the user and/or deducted from the deposit. If the deposit does not cover the entire cost, the user will be billed for the balance. Failure to make any attempt to clean up and/or pay for the additional clean up and/or damage cost will result in denial of future reservation requests in addition to forfeiture of the deposit.
Keys and Equipment Check Out.
Keys are required for use of the electricity and the gas grill at the Playground Area and the barbeque pits at Boulder Trail Park. The keys and grill equipment must be signed out from the M.U.D. office during normal business hours, Monday through Friday, 8:00 a.m. until 4:30 p.m. The office is closed on holidays. Weekend users must sign out the keys and/or equipment on the proceeding Friday (or Thursday if Friday is a holiday). If the keys are not picked up during office hours, M.U.D. personnel might be available to come to the office after hours to supply the keys. However, a charge of $50.00 will apply for this service and will be deducted from the deposit. If no M.U.D. personnel are available to perform this service, the reservation will be forfeited. Users are required to sign a statement acknowledging:
- receipt of the keys and/or equipment
- familiarity with the operating instruction of the gas grill
The keys and equipment must be returned in person. Upon receipt of these items, an inspection of the area will be performed to determine how much of the deposit will be refunded or how much additional will be charged the user for damage to the facilities.
The party making the reservation will be responsible for returning the facility/grounds to its original condition. All hard surfaces are to be cleaned of loose materials, including decorations. Trash and litter must be placed in trash receptacles or plastic garbage bags if receptacles are full. The grill must be cleaned and free of grease and all keys and equipment must be returned to the office.
Assumption of Risk.
Lost Creek Municipal Utility District shall not be liable for any loss, damage or injury that may occur or be suffered by persons who use the park facilities. Users of the park facilities assume all risks associated therewith and agree to make no claim, hold harmless, and indemnify the M.U.D., its officers, directors, agents or employees for or on account of any personal injury or property damage suffered or incurred in connection with the use of the facilities.
